Need Emergency Tree Services

Starting January 1, 2024, new tree protection legislation will be implemented in Canberra, significantly increasing the number of protected trees on private land. This legislation aims to provide enhanced protection for both private and public trees. Under these new regulations, any work that could potentially damage a protected tree, such as tree removal, pruning, utility maintenance, or construction, will require prior approval.

What Makes a Tree Protected?

A tree on private land in Canberra will be protected if it meets any of the following criteria:

It is 8 meters or taller (previously 12 meters or taller until December 31, 2023).
It has a canopy width of 8 meters or more.
It has a trunk circumference of 1 meter or more at 1.4 meters above natural ground level.
It is a dead native tree with a trunk circumference of 1.88 meters or more at 1.4 meters above natural ground level.
It was planted within the last five years as part of a Canopy Contribution Agreement.
It is a registered tree, identified as being of exceptional value and listed on the ACT Tree Register.

Canopy Contribution Agreement

If you receive approval to remove a protected tree, you will enter into a Canopy Contribution Agreement. This agreement outlines the commitment to replant trees on the block and/or make a financial contribution.

Requirements for Homeowners

For homeowners (owner-occupiers) in Canberra, the new requirements for tree removal are:

Replanting: Replant two trees on your block for each tree approved for removal. O’Brien’s Tree Services can handle this for you.
Financial Contribution: If replanting on the site is not possible, as determined by the ACT Government, a financial contribution of $600 per replacement tree not planted is required, up to a maximum of $1,200 per removed tree.

Brett and the guys removed 3 tree’s. All the proper precautions were taken, the tree’s were felled in a controlled way, restraints were used to ensure branches stayed in my yard when they fell.
